GYLA releases a statement on Kvareli governor`s impeachment

Georgian Young Lawyers` Association has released a special statement regarding the decision of the Kvareli self-government Sakrebulo, which impeached the municipal governor after noisy clashes and disputed last week. The NGO says that with this decision the Sakrebulo has violated the recommendation of the Inter-Agency Commission, which calls on the local governments to abstain from staff changes including impeachments and declaration of mistrust to elected officials.

`By impeaching the acting governor the Kvareli municipality Sakrebulo has already violated the recommendation of the Inter-Agency Commission, which calls on the local government bodies to abstain from significant staff change decisions in the pre-election period. The recommendation stipulates that the local governments should abstain from dismissing officials, including via impeachment, in order not to qualify this fact as an attempt of political pressure and influence on the results of the elections. At the same time, the developments in the Kvareli municipality indicated to the problem of confidence to an elected governor and mayors under the terms determined in the new election code of local governments. According to the amended regulations, the Sakrebulo is authorized to initiate declaration of mistrust even to the elected official even with no legal ground. We believe that this amendment endangers the stability and independence of elected figures and diminishes the significance of direct election of local authorities,` says the statement.
